US Family Based Green Card Visa

Moving to the United States of America is possible through multiple pathways. The less fortunate must get an employment or invest a stipulated amount into designated venues, while the more fortunate can get a short cut entry into the country on the basis of a nomination from a relative already residing in the USA as a national or a permanent resident.

The government has laid several pathways at the disposal of the enthusiasts through Family Based route that grants the entrants a permanent resident status of the country. This route has been the created as a part of the family reunification initiative. This route can be broadly categorized into three categories. 

The immediate relation class of Family Based Green Card can be accessed by the nationals of the country to nominate their spouses; kids – not wedded – aged under 21 years; and parents – provided the national of the USA is aged above 21 years. The recipients of the entry under this category are provided the permanent resident status. This route is a short cut pathway that sans waiting period and annual number ceiling system; and the beneficiaries do not also have to wait for the visa date to become current.

The process for this visa can be either completed through a one step procedure, or through a two phase procedure – if the beneficiaries are residing in the country at the time of initialization of the application process. The single phase procedure for this class of Family Based Green Card involves a simultaneous filing of petitions I – 486 – by the beneficiaries, and I – 130 – by the nationals of the country.

The two phase application system allows the recipients to file an I-485 at any point of time after the submission of I-130. In this process, the beneficiary must also submit a copy of I-130 – receipt, or an I–797 – notice of approval.

If the recipients of the Green Card based on Family nomination are residing out of the country, they must undergo the normal visa processing system at the local office of the embassy of the USA – located in the country of origin or current residence of the recipients of the permit.

People can also obtain a Family Based Green card under the priority immediate relation class. This permit has an annual number ceiling and also applies a waiting period. The people qualifying for this class may be any of the following:
•    Bachelor children aged over 21 years;
•    Wedded children of any age;
•    Siblings of nationals aged above 21 years.

Apart from the above mentioned programs – that allow the nationals to nominate their  nears and dears for the permanent residence of the country, the government of the USA also permits the permanent residents of the country to sponsor their married spouses, unwed children of any age for the PR visa through Family Based Green Card class. 

The visa processing for the family priority class and relations of PR class is carried out in a two phased procedure – if the recipients are already in the country. Inphase one the initiator or the nominating national must submit an I-130. On receiving an approval on the recipients can go ahead with the placement of the I-485.

In case the recipients are residing out of the country, they must undergo the visa processing formalities at the local embassy office. The process at the embassy can only begin after the individual nominating the recipients, has already filed and received an approval on I-130 for Family Based Green Card.

The program has some other complementary requirements which must be duly met by all the applicants.
